In the last five years, I’ve written a number of blogs and articles on the imposition of US state sales and income taxes where UK businesses sell to retail customers in America. This has been a developing story as the US states have attempted to impose taxes where previously it had not been thought possible.
Recently, I was asked to write an article on this for the Tax Journal, and together with my colleagues, Adam Kefford and Curt Welker, we have produced a more detailed analysis of the current position which was published a couple of weeks ago.
This is a very real issue which a number of my clients face, and whilst in the majority of circumstances they do not have sales that exceed the relevant thresholds, for those that do, this issue is now likely to come up on due diligence even if the IRS do not show an interest in the issue.
Adam and I have spent a lot of time looking at these issues with Curt, and are now well placed to advise.
